Gap Finder Terms of Service

These Terms of Service (the 'Agreement') govern your access to and use of the Gap Finder website and waitlist (the 'Service') provided by Gap Finder. By (A) accessing or using the Service, (B) submitting your information to join the waitlist, or (C) clicking a box indicating acceptance, you agree to be bound by this Agreement. If you do not agree, do not use the Service.

If you are using the Service on behalf of a company or other legal entity ('Customer'), you represent and warrant that you have authority to bind that entity, and 'you' and 'your' refer to that entity.

1. The Service

1.1 Service Description. The Service currently consists of a marketing website and a waitlist sign-up flow for Gap Finder. Gap Finder may also provide pages, text, images, FAQs, and related materials ('Gap Finder Content'). Joining the waitlist does not guarantee access to any future product, features, pricing, or availability.

1.2 Changes to the Service. We may modify, suspend, or discontinue the Service (or any part of it) at any time. We may also update these Terms from time to time as the Service evolves.

2. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect and use personal data. By using the Service, you agree that we may collect and use information as described in the Privacy Policy.

3. Eligibility

You must be at least 18 years old (or the age of majority where you live) to join the waitlist. You represent and warrant that your use of the Service complies with applicable law.

4. Your Submissions

4.1 User Submissions. Any information you submit through the Service (including your email address and any optional responses) is a 'User Submission.' You are responsible for your User Submissions and represent that you have the right to provide them.

4.2 License to Operate the Service. You grant Gap Finder a non-exclusive, worldwide, royalty-free license to host, store, process, and use your User Submissions solely as necessary to operate the Service (including managing the waitlist, communicating with you, and maintaining security) and as otherwise described in the Privacy Policy.

5. Ownership

5.1 Gap Finder Materials. Gap Finder (and its licensors) own all rights, title, and interest in the Service, Gap Finder Content, branding, and underlying technology, including all intellectual property rights ('Gap Finder Materials'). Except for the limited rights expressly granted to you, no rights are granted and all rights are reserved.

5.2 Feedback. If you provide suggestions or feedback, you grant Gap Finder a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or obligation to you.

6. Acceptable Use and Restrictions

You agree not to (and not to allow others to):

  • Use the Service in violation of law or to infringe others' rights
  • Attempt to gain unauthorized access, disrupt, overload, probe, scan, or test the vulnerability of the Service
  • Introduce malware, scraping that materially burdens the Service, or automated abuse
  • Reverse engineer, decompile, or attempt to discover source code or non-public APIs (except to the extent prohibited by law)
  • Remove or obscure proprietary notices or branding

We may suspend or block access if we reasonably believe your use presents a security risk, violates these Terms, or could harm the Service or others.

7. Third-Party Services

The Service may use or link to third-party services (e.g., hosting, analytics, email delivery). Your use of third-party services is governed by their terms and policies, and Gap Finder is not responsible for third-party services.

8. Disclaimers

The Service and Gap Finder Materials are provided 'as is' and 'as available.' Gap Finder disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that joining the waitlist will result in access to any future product.

9. Limitation of Liability

To the maximum extent permitted by law, Gap Finder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to the Service or this Agreement. To the maximum extent permitted by law, Gap Finder's total liability for any claim arising out of or related to this Agreement will not exceed USD $100.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated this Agreement or if necessary to protect the Service, users, or third parties. You can opt out of waitlist communications at any time using an unsubscribe link (if provided) or by contacting us.

11. Governing Law and Venue

This Agreement will be governed by the laws of [Jurisdiction], without regard to conflict of law rules. Any dispute arising out of or relating to this Agreement will be brought exclusively in the courts located in [Venue], and you consent to their jurisdiction.

12. Miscellaneous

12.1 Severability. If any provision is found unenforceable, the remaining provisions will remain in effect.

12.2 Assignment. You may not assign this Agreement without our consent. We may assign this Agreement in connection with a merger, acquisition, reorganization, or sale of assets.

12.3 Entire Agreement. This Agreement and the Privacy Policy constitute the entire agreement regarding the Service and supersede prior understandings.
